Introduction
Phenix Services Pty Ltd (ABN 18 667 168 103), trading as Safe Metrics (referred to as "Safe Metrics", "we", "us" or "our"), is committed to protecting your privacy. We comply with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs), which regulate how we collect, use, store, and disclose personal information.
In this Privacy Policy, "personal information" means any information that identifies you or could identify you. This Policy outlines what personal data we collect (for example, information you provide via contact forms, emails, or through cookies on our website), how we handle and secure that data, how you can access or update your information, and the circumstances under which we may share information with third-party service providers.
Personal Data We Collect
We only collect personal data that is reasonably necessary for our business to provide occupational safety, occupational hygiene, and construction estimation services. The types of personal information we may collect include:
- Contact Information: When you fill out a contact form on our website, call us, or email us, we may collect your name, email address, phone number, company/organisation name, and any other information you choose to provide. This is used to respond to inquiries, provide quotes, and deliver our consulting services.
- Service Information: If you engage our services, we may collect details related to your project or workplace (e.g. site location, number of employees, specific safety or hygiene concerns). This information helps us tailor our professional advice but may include personal information (for example, names of staff or contractors involved in a project). We limit our collection to what is necessary for the agreed purposes.
- Website Usage Data and Cookies: When you visit our website, certain information is collected automatically through cookies and similar technologies. This may include your IP address, browser type, the pages you visit, and the times you access them. We use third-party analytics (such as Google Analytics) to gather aggregated, anonymous statistics on site visits. This information is not used to identify you and is collected to improve our website and services. You can adjust your browser settings to refuse cookies or alert you when cookies are being used.
- Email and Communications Data: If you subscribe to any Safe Metrics mailing list or request newsletters/updates (if we offer these), we will collect your name and email address for that purpose.
We do not normally collect sensitive information (such as health data, etc.) through our website. If, in the course of providing services, we need any sensitive information, we will collect it only with your consent or as required by law and handle it in accordance with the Privacy Act.
How We Use Personal Information
Safe Metrics uses the personal information we collect for legitimate business purposes, including:
- Providing and Improving Services: We use contact and project information to communicate with you, understand your needs, and carry out our consultancy services as requested.
- Communication: We may use your contact details (email, phone) to respond to inquiries, send appointment reminders, reports, or updates related to services you have engaged. If you are an ongoing client, we might also provide updates on relevant services or regulatory changes in occupational safety/hygiene that may affect you.
- Administration and Records: We maintain records of our clients and projects (which may include personal information of contacts) for administrative purposes, such as invoicing, project management, and record-keeping required by law or our professional standards.
- Website User Experience: Data collected through cookies/analytics is used to improve our website's user experience and troubleshoot technical issues. This data is aggregated and does not identify individuals.
- Legal Compliance and Protection: In some cases, we may use or disclose your information as required by law, or to enforce our agreements and protect our rights.
We will not use your personal information for purposes other than those you would reasonably expect, or as otherwise permitted by law. If we ever need to use your data for a new purpose not covered here, we will seek your consent first.
How We Store and Protect Your Data
We take reasonable steps to securely store personal information and protect it from unauthorised access, alteration, or disclosure. Personal data we hold may be stored in electronic databases (on secure servers) and in some instances in physical form (for example, printed reports or field notes).
We use industry-standard security measures to safeguard data, including:
- Password protection
- Encryption where appropriate
- Firewall and antivirus technologies
- Access controls to restrict personal data to staff who need it for their duties
Safe Metrics may use reputable third-party cloud service providers for data storage (e.g., email or file storage). When we use external servers or cloud services, we ensure they have robust security and privacy policies.
In the unlikely event of a data breach that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme under Australian law.
Disclosure of Personal Information to Third Parties
Safe Metrics does not sell or rent your personal information to third parties. We will only disclose your personal information in specific situations:
- Service Providers: We may share necessary personal information with trusted third-party service providers who assist us in conducting our business. This includes IT and web hosting providers, cloud storage or email service providers, analytics services (such as Google Analytics), or subcontractors/consultants. These third parties are contractually obligated to protect your information and use it only for the agreed-upon purpose.
- Legal Obligations: We may disclose personal information if required by law or lawful request – for instance, under a court order, or regulatory investigation.
- Business Transactions: In the unlikely event that our business is involved in a merger, acquisition, or sale, personal information held by Safe Metrics may be disclosed to the advisors or parties engaged for due diligence or transfer of business assets.
- With Your Consent: If you specifically request or consent to us sharing your information with a third party, we will do so as instructed.
We do not disclose personal information to third parties for them to market their services to you without your consent.
Third-Party Websites
Our website may contain links to third-party websites or use third-party integrations (for example, social media plugins or map services). Please be aware that we do not control the privacy practices of external sites.
If you click on a link to an external website, the privacy policy of that site will apply to any information you provide there. Refund & Cancellation Policy
Introduction
This Refund & Cancellation Policy sets out the terms under which Phenix Services Pty Ltd (ABN 18 667 168 103), trading as Safe Metrics, handles cancellations of services and any applicable refunds. By engaging our services or paying for a booking, you agree to this Policy, which is designed to be fair and in accordance with the Australian Consumer Law (ACL).
1. Cancellation by the Client
We understand that our clients may need to cancel or reschedule services. The following rules apply:
- Cancellation Notice: Cancellations made 7 days or more before the scheduled service date will not incur any cancellation fee, and any pre-paid amount will be refunded in full (except for any expressly non-refundable deposit).
- Late Cancellation (Within 3 Days): If you cancel a service with less than 3 days' notice, we reserve the right to charge a cancellation fee or retain a portion of the service fee to cover time allocated and preparatory work already done.
- Cancellation After Commencement: If you terminate our services after work has commenced, Safe Metrics will charge for the work completed up to the cancellation date. We will refund any remaining portion minus any non-refundable components.
2. Cancellation by Safe Metrics
On rare occasions, Safe Metrics may need to cancel or postpone a service due to unforeseen circumstances. In such cases, you will be entitled to a full refund of the amount you paid for that service, unless you agree to reschedule.
3. Deposits and Non-Refundable Components
Some of our services may require a deposit or prepayment to secure the booking. Any required deposit and whether it is non-refundable will be clearly communicated to you before you confirm the booking. Non-refundable deposits cover administrative work, preliminary consulting work, and any expenses incurred in advance.
4. Australian Consumer Law Rights
Nothing in this Policy is intended to limit your rights under the Australian Consumer Law (ACL). Under the ACL, services come with certain consumer guarantees. If Safe Metrics fails to meet a consumer guarantee, you are entitled to remedies which may include a refund, regardless of this Policy.
